Terms of Service

1. Who these terms are between

These terms are a contract between KS Digital L.L.C-FZ, a limited liability company registered in the Meydan Free Zone, Dubai, United Arab Emirates (formation number 2643241) ("we", "us") and you — the person or organisation using KS Property Maps. If you're using KS Property Maps on behalf of an organisation, you confirm you're entitled to accept these terms for it, and "you" means that organisation. By creating an account or using the service, you accept these terms.

2. What KS Property Maps is

KS Property Maps is a subscription service for mapping and managing a property portfolio: your sites, competitors, and strategy points, with tools for your team to view and edit them. We grant you a non-exclusive, non-transferable right to use the apps and service for your organisation's internal business purposes while you have an active subscription or trial.

3. Accounts and teams

You need an account to use KS Property Maps, and you're responsible for keeping your sign-in credentials secure. The account owner for an organisation controls who is invited, what roles they hold, and is responsible for their team's use of the service. Tell us promptly at support@ksdigital.io if you suspect unauthorised access.

5. Your content

The property records, competitor entries, strategy points, notes, and photos your team adds remain yours. You grant us the licence needed to host, process, back up, and display that content to your team — solely to provide the service. You're responsible for having the right to upload what you upload, and for its accuracy and legality. Our Privacy Policy explains how we handle personal data.

6. Acceptable use

You agree not to: use the service unlawfully or to store unlawful content; attempt to access other organisations' data; probe, disrupt, or overload the service; reverse-engineer the apps except where the law allows; resell or provide the service to third parties as your own; or use the service to build a competing product. We may suspend accounts that put the service or other customers at risk, and will tell you why unless the law prevents it.

7. Service availability and your data

We work to keep KS Property Maps available and your data safe, and our hosting includes routine backups. But no online service can promise uninterrupted availability, and KS Property Maps is provided "as is". You're responsible for keeping your own exports of business-critical data — the app's export tools exist for exactly that.

8. Our liability

Nothing in these terms limits liability that cannot be limited under the law of England and Wales, including for death or personal injury caused by negligence, or for fraud. Subject to that: we are not liable for indirect or consequential losses, loss of profits, or loss of data caused by events outside our reasonable control; and our total liability to you in any 12-month period is capped at the amount you paid us for the service in that period. KS Property Maps is a business tool — you're responsible for the commercial decisions you make using it.

9. Ending things

You can stop using KS Property Maps at any time — cancel the subscription in your store settings, and delete your account in the app or by emailing us. We may end these terms if you materially breach them and don't fix the breach within 14 days of being told, or if we discontinue the service, in which case we'll give reasonable notice so you can export your data.

10. The app stores

Where you got the app from Apple's App Store or Google Play, you also agree to their terms. Apple and Google aren't parties to these terms, have no responsibility for the service or its support, and (in Apple's case) are third-party beneficiaries of these terms entitled to enforce them against you.

11. Intellectual property

KS Property Maps's software, design, and branding belong to us. Nothing in these terms transfers them to you beyond the right to use the service.

12. Changes to these terms

If we make material changes, we'll update the date above and tell you in the app or by email before the changes take effect. Continuing to use the service after that means you accept the updated terms.

13. Law and disputes

These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales — though we'd much rather you emailed us first so we can put things right.
